SIR,
I desire, most respectfully, to submit the following representation to the Secretary of State for War :---
1. I have applied for retirement from the Army on a pension of £300 a year, under the compulsory retirement clause, No. 972 C of the Royal Warrant
pay
and pension, 1884; being a substantive Major 48 years of age.

I also notified to the Military Secretary, that I had received from the Colonial Office an offer of the appointment of Superintendent of the Prison at Hongkong, with a salary of about £620 a year, and that I intended, after having been retired from the Army, to accept this appointment, provided I was per- mitted to draw my Military Pension in addition to the pay of this office (para.
990, Pay and Pension Warrant).
3. In accepting my retirement, and informing me that it would appear in
59833 an early Gazette, the Military Secretary added, in his letter No. of 23rd
49 instant, addressed to the General Officer commanding at Dover: "He (myself) "should clearly understand, that inasmuch as this retired pay has been earned

partly by Colonial employment, he cannot draw any portion of it while hold-
"ing a Colonial appointment."
4. It is on this point, which so materially affects my interests, that I am anxious to make a representation.
5. I have a total service of upwards of 29 years. During five years of this
service-from 18th November, 1879, to 17th November, 1884--I was seconded
for service in Cyprus. But, as I read article 972 of the Royal Warrant, I am entitled to my retirement of £300 a year-whatever my length of service or in whatever capacity I may have served-simply by my having attained 48 years of age; being a substantive Major who has served as such. And it appears to me very hard, that because I happened for some time to serve under the Colonial Office, my pension, earned by 29 years' service, should be withheld from me if I again entered the service of that Department; especially, as it would appear from the terms of the Military Secretary's letter, that this would not be the
